Debt collection is a sensitive field governed by strict rules. At EOS France, we are deeply committed to transparency and fair practices. On this page, we want to clearly inform you about the regulations that govern us, our licenses, and all our obligations, to guarantee you fair and respectful treatment.

Our main activities include debt purchasing, third-party debt collection, and contact information searches. 

Each of these specialties is subject to strict regulations and requires specific authorizations, ensuring our full compliance and the protection of your rights.

Third-party debt collection

EOS France complies with the obligations set out in Articles R124-1 to R124-7 of the French code of civil enforcement procedures, applicable to third-party debt collection companies:

  • Declaration to the Public Prosecutor.
  • Holding adequate Professional Liability Insurance.
  • Using bank accounts exclusively dedicated to receiving funds collected on behalf of creditors.
  • Systematically sending an initial information letter that includes the mandatory information specified in the code of civil enforcement procedures and information related to data protection regulations.
  • A prohibition on charging debtors any fees other than the legal fees provided by law.
  • Providing a final statement of account.

Debt purchasing

EOS France is licensed as a Credit Servicer for the collection of debts falling within the scope of the European Directive of November 24, 2021, transposed into French law by the Ordinance of December 6, 2023, and its implementing decree of December 20, 2023.

This concerns all past-due bank claims:

  • assigned to EOS France by a credit institution or financing company since 12/31/2023, for which EOS France manages the collection on its own behalf;
  • or managed by EOS France on behalf of a credit purchaser, relating to claims assigned by a credit institution or financing company since 12/31/2023.
  • As a credit servicer, EOS France is licensed by the French Prudential Supervision and Resolution Authority (ACPR) under number 488 825 217.In this capacity,

EOS France complies with the following obligations, among others:

  • Systematically sending an initial information letter that includes the mandatory information specified in the Monetary and Financial Code, as well as information related to data protection regulations.
  • Using a segregated account exclusively for receiving funds collected on behalf of credit purchasers.
  • Systematically sending a receipt for every payment.
  • Compliance with obligations related to anti-money laundering and counter-terrorism financing under the Monetary and Financial Code.
  • Implementation of a transparent and free complaints handling process.

Civil investigations

Employees who conduct searches for the contact information of missing debtors are licensed as Civil Investigators ("ARP") by the National Council for Private Security Activities (CNAPS), under the direction of the Ministry of the Interior. This is regulated by Book VI (Titles II and III) of the Internal Security Code.

EOS France is authorized to operate as a Private Research Agency under Authorization No. AUT-075-2119-01-28-20200385571, issued by CNAPS on January 28, 2020.
SIP - Société d’Investigation Privée is authorized to operate as a Private Research Agency under Authorization No. AUT-075-2112-12-25-20130361445, issued by CNAPS on December 26, 2013.

It respects and applies the provisions of the charter of good conduct signed between the ASF (Association française des Sociétés Financières) and Consumer Associations.
